Blaze hits showcase skyscraper in Moscow

MOSCOW (Reuters) - A fire broke out at a partly-built Moscow skyscraper on Friday, Russian officials said, the second in the Kremlin-backed Moskva City business center development in less than a year.

The blaze erupted before noon on the 24th floor of the Oko ('Eye') tower, but was put out quickly put out, according to a statement on the Emergency Ministry's website.

The fire was sparked by a fan heater used to warm liquid concrete, according to Lifenews.ru, a tabloid website with close connections to the law enforcement agencies. One construction worker was taken to hospital with burns, it said.

Last April, fire swept through the top floor of the incomplete Vostok ('East') tower of Moskva City's Federation complex, which will be the tallest building in Europe when finished, at 360 meters (1,181 feet).

Moskva City, a district of glittering concrete and glass towers west of the Moscow's historic center, is part of a Kremlin-backed project to make the capital a global financial center by 2020 - a plan that critics say is hampered by a lack of modern infrastructure.

The Kremlin is desperate to raise the profile of Russia, the world's largest energy exporter, in the eyes of foreign investors who complain about excessive state regulation of the economy and rampant corruption.

Donation As An Estate Planning Tool (A Discussion on Donor's Tax)

Donations, estate planning, and donor's taxReal property, just like any other material possession, may not be brought to the afterlife. You need to transfer property sooner or later. Usually, however, the transfer of property prior to death is a taboo subject so many end up dealing with property transfer problems only after a person has died. It is always good to be prepared since we will all surely die ? there is simply no escaping it.

Read on to learn more about donor?s tax and how it can help you prepare for the inevitable.

Why donate your properties prior to death?

Donation may be considered as an estate planning tool because you are able to transfer your properties prior to death little by little every year and therefore you can take advantage of the graduated donor?s tax rates. If you have a lot of properties at the time of death, the estate tax would be higher because the total amount of the properties will probably fall under a higher tax rung.

On another note, it is usually the case that the family spends a lot for medical care prior to death, and because of this, the family?s cash reserves are depleted. If the family is not liquid and they need to pay the estate tax within six months from the time of death, many times the family is forced to sell their properties below market value because they are under time pressure. It is during these pressure points that many investors are able to buy good properties at a good price. I don?t want to view it as taking advantage of the misfortune of others ? rather, I want to think of it as the investors helping the family solve their cash problem. If no one bought the property, the family would be in a worse situation.

Another problem that may arise upon death is that the children or heirs will be fighting each other for their ?rightful? share of the deceased?s property. I don?t think any parent would want their loved ones to be fighting over money or property. If the properties are already distributed as agreed upon by all parties prior to death, then this problem may be alleviated.

Lastly, I believe that a person who already thought in advance of the transfer of properties prior to death, and actually had no more significant properties to transfer upon death, would be at peace upon death because he/she did not leave problems to his/her family. Dealing with grief is hard enough, it would be difficult to deal with the nitty-gritty taxes and what-not during a most stressful time.

Of course, there are downsides to donation too ? Who shall control the properties? Who gets the fruits/rental income? etc? etc? These may be answered by trusts and other legal documents. But for now, let?s deal with straightforward donation.

What is Donor?s Tax?

Donor?s tax?is imposed on tax on the transfer by any person, resident or non-resident, of a property by gift. For an overview on donor?s tax, please check the BIR website. The legal basis for donor?s tax may be found in Sec. 98 to Sec. 104 of the National Internal Revenue Code (NIRC) (aka the Tax Code). Check also the Donor?s and Estate Tax Regulations (BIR Revenue Regulations No. 2-2003) and Revenue Memorandum Order (RMO) No. 1-98.

What is the tax base?

The donor?s tax base shall be the total value of the net gifts during the taxable year. The value of the net gifts shall be based on the fair market value (FMV) of the gifts at the time of donation.? In case of real property, the tax base shall be the BIR Zonal Value or FMV per Tax Declaration, whichever is higher. If there is no Zonal Value, the tax base shall be the FMV based on the latest tax declaration. If there is an improvement (like a house or a building), the FMV of the improvement shall be the construction cost based on the building permit and/or occupancy permit plus 10% per year after the year of construction, or the FMV based on the latest tax declaration.

The term ?net gift?, for purposes of donor?s tax, pertains to the net economic benefit which the done gets from the transfer. Thus, if a property encumbered with a mortgage is transferred as a gift, but the? donee is required to pay the mortgage, then the net gift is computed by deducting the amount of mortgage assumed by the donee from the fair market value of the property given as a gift.

If you donate on different dates within a year, a donor?s tax return shall be filed for each date of donation, and the donor?s tax base shall be based on the accumulated donations for the current calendar year (January 1 to December 31). Thus, the more gifts you make within a calendar year, the higher the probability that the donor?s tax will fall on a higher tax bracket. Note though, that donor?s tax previously paid on previous donations shall be deducted from the donor?s tax payable. The good news here is that you will get a fresh start for each year, and effectively, you can donate P100,000 in cash or in kind at zero donor?s tax.

You may even donate cash which the donee can use to purchase property, so the property can be in the name of the donee. For example, a parent can donate cash for installment payments of property so that the property may be declared in their child?s name, since the child cannot purchase directly without a source of income.

Please note that in case of donation to relatives (not strangers), only one return shall be filed for several gifts/donations by the donor (the one giving the donation) to the different donees (those receiving the donation) on the same date. If the gift/donation involves conjugal or community property, each spouse shall file a separate return for their respective shares in the said property.

Deemed Gift

If you purchased a property below its fair market value (FMV), the difference between the FMV and the selling price shall be deemed a gift of the seller, subject to donor?s tax. This is also called a transfer for less than adequate consideration.

Exemptions from Donor?s Tax

  1. Dowries or gifts made on account of marriage and before its celebration or within one year thereafter by parents to each of their legitimate, recognized natural, or adopted children to the extent of the first Ten thousand pesos (P10,000);
  2. Gifts made to or for the use of the National Government or any entity created by any of its agencies which is not conducted for profit, or to any political subdivision of the said Government; and
  3. Gifts in favor of an educational and/or charitable, religious, cultural or social welfare corporation, institution, accredited non-government organization, trust or philanthropic organization or research institution or organization, provided, however, That not more than thirty percent (30%) of said gifts shall be used by such donee for administration purposes.

Based on the BIR website, the following are likewise exempt from donor?s tax:

  1. Encumbrances on the property donated if assumed by the donee in the deed of donation
  2. Donations made to the following entities as exempted under special laws:
  • Aquaculture Department of the Southeast Asian Fisheries Development Center of the Philippines
  • Development Academy of the Philippines
  • Integrated Bar of the Philippines
  • International Rice Research Institute
  • National Social Action Council
  • Ramon Magsaysay Foundation
  • Philippine Inventor?s Commission
  • Philippine American Cultural Foundation
  • Task Force on Human Settlement on the donation of equipment, materials and services

What are the Donor?s Tax rates?

The donor?s tax rate will be based on the law prevailing at the time of donation.

For donations made on January 1, 1998 up to the present, if the donee is a stranger, the donor?s tax rate is thirty percent (30%).

A stranger is a person who is not a brother, sister (whether by whole or half-blood), spouse, ancestor and lineal descendant, or a relative by consanguinity in the collateral line within the fourth degree of relationship. This just means you are related by blood, and you count the degree by going up first to the person who ?connects? you then go down.

For example, your first cousin is within the fourth degree. You go ?up? to your dad (1 degree), then ?up? to your lolo (1 degree), then go ?down? to your uncle who is your dad?s brother (1 degree), then ?down? to your first cousin (1 degree), so 4 degrees in all.

Note that a child who is legally adopted is not considered a stranger. Donations between corporations or from an individual to a corporation shall be considered as donations to a stranger.

When to pay

Within thirty (30) days after the date the gift is made. If more than one gift or donation is made within one year, a separate return should be filed for each gift/donation within thirty (30) days after the date the gift is made.

BIR Form No. 1800 (Donor?s Tax Return)

Where to file and pay/ Filing procedure

Prepare three copies of the donor?s tax return (two copies shall be for the BIR and one copy shall be for the taxpayer) and file them with any Authorized Agent Bank (AAB) of the Revenue District Office (RDO) having jurisdiction over the place of the domicile of the donor (that is, where the donor lives) at the time of the transfer.

In places where there are no AAB, the return will be filed directly with the Revenue Collection Officer or duly Authorized City or Municipal Treasurer where the donor was domiciled at the time of the transfer. If the donor has no legal residence in the Philippines, file the return with Revenue District No. 39 ? South Quezon City (this is along Quezon Avenue, with a DBP branch at the ground floor).

In the case of gifts made by a non-resident alien (that is, not a Filipino citizen), the return may be filed with Revenue District No. 39 ? South Quezon City, or with the Philippine Embassy or Consulate in the country where donor is domiciled at the time of the transfer.

Penalties for late payment

Same as other taxes, 25% surcharge plus 20% interest per year (under Secs. 248 and 249 of the Tax Code, respectively). If there is fraud, the surcharge shall be 50%. You may also pay compromise penalties in lieu of imprisonment (click on the link for the schedule of compromise penalties).

Documentary requirements

Based on the BIR website, the following requirements must be submitted before the Tax Clearance Certificate/Certificate Authorizing Registration (that is, the document required for the title to be transferred) can be released:

1. Deed of Donation
2. Sworn Statement of the relationship of the donor to the donee
3. Proof of tax credit, if applicable
4. Certified true copy(ies) of the Original/Transfer/Condominium Certificate of Title (front and back ) of lot and/or improvement donated, if applicable
5. Certified true copy(ies) of the latest Tax Declaration (front and back pages) of lot and/or improvement, if applicable
6. ?Certificate of No Improvement? issued by the Assessor?s office where the properties have no declared improvement, if applicable
7. Proof of valuation of shares of stocks at the time of donation, if applicable
? For listed stocks ? newspaper clippings or certification issued by the Stock Exchange as to the par value per share
? For unlisted stocks ? latest audited Financial Statements of the issuing corporation with computation of the book value per share
8. Proof of valuation of other types of personal properties, if applicable
9. Proof of claimed deductions, if applicable
10. Copy of Tax Debit Memo used as payment, if applicable

Additional requirements may be requested for presentation during audit of the tax case depending upon existing audit procedures.

Documentation of the donation

Consult a lawyer with regard to the format of the Deed of Donation, and make sure that the donation is properly accepted and notarized during the lifetime of the donor.

Astronaut shares secret of Zero-G fingernail clipping

Life in space isn't easy. Even basic hygiene, like clipping your fingernails, is a cosmic challenge without gravity, one astronaut says.

A new video by Canadian astronaut Chris Hadfield shows exactly how complicated (and a little gross) it is to cut your nails in the weightless environment of space. Hadfield currently lives on the International Space Station, where astronauts are forced to devise inventive ways for dealing with basic bodily needs that many folks may take for granted on Earth.

"Now, if I just cut my fingernails here, fingernail bits are going to fly everywhere," Hadfield explained in the zero gravity nail-clipping video as he floated about inside the space station. "They won't fall to the ground. You can't sweep them up. They'll float everywhere. They get in your eyes, people breathe them. Not good. Got to figure out a plan."

Hadfield's solution is to position his hand over an air duct where air is pulled in and filtered throughout the station. The nail clippings get sucked into the duct's mesh filter, making cleaning up relatively simple.

"So, there we go," Hadfield said. "Nails are ready for guitar playing. I'm going to vacuum this [the air duct] later in the week. It'll all clean up just fine."

There are many other ways astronauts tackle daily life without the pull of gravity. They attach strips of Velcro to all of their belongings since anything that isn't tied down can float away and get lost somewhere inside the International Space Station, which has the same habitable space as a five-bedroom house.

The astronauts share hair-cutting duty with their crewmates, using a vacuum to clean up clippings after each snip. A complicated procedure using hoses and airflow allows astronauts go to the bathroom in space. There are two toilets for the six astronauts living on the space station today.

Hadfield is a flight engineer representing the Canadian Space Agency on the station's Expedition 34/35 crew. Two American astronauts and three Russian cosmonauts round out the team. In March, Hadfield will take command of the station's Expedition 35 crew, to become Canada's first space station commander.

Hadfield has already developed a reputation for snapping amazing photos of Earth from space, writing and performing songs in space on the guitar, and Tweeting with celebrities like William Shatner, "Star Trek's" famed Captain Kirk, since arriving on the station last month.

Seeking `Higher' Ground: The Dangers of Designer Drugs

Since ancient times, humans have been fascinated with ways to alter consciousness, and have gone to great lengths to reach a ?higher??ground.? From naturally occurring substances such as opium and betel nuts, to synthetic drugs like LSD, people have long experimented with mind-altering substances. This long history of experimentation with psychoactive substances even pre-dates the existence of the word ?drug.?

For example, Native Americans??use of mescaline, extracted from peyote cacti, began as long as 5,700 years ago. Use of the Betel nut ??the seed of a palm tree fruit ??to alter consciousness may not be well-known in the U.S., but this practice has existed for thousands of years. In fact, it is estimated that among intoxicants, only nicotine, alcohol and caffeine are more popular globally than chewing Betel nut extract.

But the latest wave of man-made drugs, or ?designer drugs,??carries new and very real dangers.? For both the individuals using them and the general public, so-called designer drugs like ?bath salts,???K2??or ?spice??quickly have become a public health crisis, and their use is on the rise.? Their danger is related to the potent effect these drugs can have on the human nervous system.? For example,? ?bath salts? (chemically known as synthetic cathinones) combine the dangerous properties of both a potent stimulant and a hallucinogen.? ?K2? is a type of synthetic marijuana (the active compound is THC) and is dangerous because it can be more potent than the naturally occurring plant.

These new designer drugs are proliferating because in many states they are sold ?legally.??This is possible because they are deliberately designed with an alteration to the molecular structure of an existing drug ? to avoid classification as an illicit drug.

Despite their recent proliferation, ?designer drugs?? are not really new ??the term was coined by law enforcement in the 1980s, and widely recognized drugs like LSD, ecstasy and methamphetamines fall into this category.? The latest generation of designer drugs includes synthetic cathinones (commonly labeled with harmless-sounding monikers like ?bath salts??or ?plant food?), which are structurally and pharmacologically similar to cocaine, methamphetamines and ecstasy (MDMA). Synthetic cannabinoids, often branded as ?Spice?? or ?K2,??are chemically engineered to mimic marijuana.? There are many other potent designer drugs with names like Europa and Smiles that are increasing in use. Many of these designer drugs are available legally in drug paraphernalia stores, convenience stores or even via the Internet.? That?s right, legally. Like many cyber sales, delivered to your door with free shipping.

Law enforcement officials are increasing efforts to monitor for and curtail the use of these dangerous drugs.?? For example, the Drug Enforcement Administration (DEA) now includes three synthetic cathinones on its Schedule 1 list of controlled substances and several of the chemicals found in synthetic cannabinoids are banned under the Food and Drug Administration Safety and Innovation Act of 2012. But many similar compounds are not yet classified as illegal and in some cases they have not even been identified. This is because the ?chemists? who produce designer drugs make incremental alterations to the drugs? chemical make-up, dodging Schedule 1 or illegal classification on a technicality, and thereby claiming to provide a ?legal? high.

For law enforcement officials and regulators, keeping up with these chemists is a game of cat-and-mouse, with potentially deadly consequences. Bath salts carry a high risk of overdose and addiction, chest pains, increased blood pressure, increased heart rate, agitation, hallucinations, extreme paranoia, and delusions1.? Reported side effects of K2 and Spice include paranoia, panic attacks, giddiness and psychotic episodes.2 Despite these risks, their use is on the rise at an alarming rate.? In 2011, the National Poison Control Centers received more than 6,000 calls about synthetic cathinones (including bath salts), compared to only 300 in 20103.? The American Association of Poison Control Calls reported a 58 percent increase in the number of calls related to synthetic marijuana and/or K2/Spice in just one year ? from 2,906 calls in 2010 to 6,959 calls in 2011.4

To make matters worse, the popularity of these drugs is fueled by the frequent claim that standard urine drug screens will not detect their presence. Luckily, there is a new solution that can detect these substances.

Sophisticated laboratory technologies using mass spectrometry assays of urine specimens can identify the vast majority of legal and illegal drugs ingested, since most small molecules have metabolites (i.e., break down products) that are excreted by the kidneys and into the urine. Mass spectrometry assays currently used to detect and monitor use of powerful pain medications (e.g. opioids) can be mobilized to help physicians and regulators, such as the DEA, detect these new designer drugs.

Specialty laboratories are using these advanced technologies to anticipate new chemical formulations and launch new tests to detect dangerous substances.? For example, long before bath salts were a problem in the U.S., the United Kingdom was struggling with increasing rates of overdose and death due to synthetic cathinones.? Reports from British physicians, and the laboratory scientists, prompted U.S.-based scientists to develop new tests that would detect multiple synthetic cathinones ? even variations that were not yet classified by DEA as Schedule 1 substances.

Because physicians are on the front lines ?? typically seeing the effects of designer drugs in the emergency room, office examination room, or hospital ??drug monitoring using mass spectrometry is a critical tool to identify and prevent the use of designer drugs.? Consequently, physicians are increasingly relying on specialty laboratories to help identify the compounds present in patients who are taking controlled medications who are at risk for drug misuse or abuse.

Tackling the threat to public health posed by the proliferation of designer drugs will require efforts from multiple stakeholders.?? Policymakers are beginning to take important action.? In addition to the national ban on several types of synthetic drugs signed this summer by President Obama, both New Jersey and Washington, D.C., have enacted similar bans in recent weeks.5,6 But the new laws will not save lives without additional action and support.

Regulators and the DEA could make better use of advanced drug detection technologies to more quickly classify new designer drugs as illegal.? Insurance companies must be encouraged to support these efforts by ensuring reimbursement for specialty labs, so that doctors have access to the best technology available to detect and identify designer drug compounds. Data about drug use trends must be provided to the DEA and physicians to educate clinicians on any new dangerous drugs ? and physicians must be vigilant in testing patients who are at risk for drug abuse and misuse.? Finally, the public must be educated about this dangerous category of drugs ? especially because users commonly assume that if a drug is not technically ?illegal,? it is safe to use.

In summary, we have a new major public health threat that represents just the latest step in man?s creative pursuit of new ways to get high.? History tells us that we can?t completely eliminate this threat, but by pooling our knowledge and streamlining legal and regulatory processes, we can succeed in reducing the threat of designer drugs and enhancing public safety. Is there True Friendship Between Genders? ? Chengdu Forum

This is an age old question. Can people of the opposite sex truly be friends without ever feeling something for each other at some point?

In my experience, the answer to that question is yes, I have (girl)friends that I haven't even thought about dating, even though I find some of them attractive. Where it gets complicated is that, even if I feel that way, there's no guarantee that she feels the same. She could be completely in love with me, which, well, would complicate our relationship a lot. Of course, the opposite can happen as well. I might have a huge crush on a girl, but she might just see me as a friend. (The friend zone!)

In my personal experience, if the girls are slightly older or younger than me, what will usually form is some type of pseudo ''brother sister'' type of relationship.

To me, based on what your writing, it sounds like your way past that point. You no longer see each other as ''just friends'', you already seem to care for each other at a romantic level. This is
of course natural.

And yes, many romantic relationships do begin with friendship, in fact, many people think that the best relationships begin that way, since you already are comfortable with each other.

Only you can decide what to do, you could essentially just friend zone him and say you want to simply stay as friends and force it over your own feelings and his, which might be painful but worth it in the end. Or you could just cut him off completely, which of course will be painful as well. Or maybe just go for it? Dunno!

Snow and ice cause flight cancellations in Frankfurt

FRANKFURT (Reuters) - Passengers suffered delays and flight cancellations on Monday at Frankfurt airport, Europe's third busiest, after freezing rain had forced the airport to shut late on Sunday.

About 300 of the 1,200 scheduled arrivals and departures are expected to be cancelled, a spokesman for airport operator Fraport said.

On Sunday, 445 flights out of 1,170 were cancelled.

Ground staff for German airline Lufthansa were handing out bottles of water and bars of chocolate to people waiting in hour-long queues for rebookings and baggage drop.

"It's a disaster," said one man, who had been trying to fly to Turkey since Sunday evening.

In the city, whose skyline was barely visible through the icy fog, trams sat idle because sub-zero temperatures had frozen overhead lines and many commuter trains were delayed.

Icy roads and accidents caused kilometres-long traffic jams on motorways in the area, and a number of schools in the region remained closed for the day.

It's not only important to microchip both dogs and cats - I do stress both dogs and cats....people forget about cats, figuring they are indoors only. Surprising data reveals that indoor cats do, in fact, get out. When they do, some stand frozen like statues, others make a mad dash and others hide. Except for those cats in the first category they are not easy to recover.

Delhi gang-rape case to start in fast-track court

NEW DELHI (AP) ? Legal proceedings in a gang-rape case that has sparked protests about the treatment of woman are beginning in a new fast-track court set up specifically to deal with crimes against women in New Delhi.

Five men are due to appear in the special court Monday afternoon to face charges they raped and murdered a 23-year-old student aboard a moving bus in the capital last month.

A sixth suspect in the attack claims to be a juvenile and his case is being handled separately.

The attack has brought the little discussed topic of crime against women to the forefront in India. However some activists have raised concerns that the fast-track court system was not the answer to protect women.

Colombia's FARC rebels end ceasefire

HAVANA (Reuters) - A unilateral ceasefire declared by the Marxist FARC rebels at the start of peace talks with the Colombian government ended on Sunday after the government refused to join the truce, the group said.

"With pain in my heart, we have to admit that we return to the stage of war that nobody in this country (Colombia) wants," FARC lead negotiator Ivan Marquez told reporters before going into the latest session of the talks aimed at ending Colombia's long, bloody conflict.

The FARC, or Revolutionary Armed Forces of Colombia, declared the ceasefire when the talks began on November 19 in Havana, and gave the Colombian government two months to also lay down its arms.

"The fact is that the number of operations carried out by the group decreased significantly, the number of police and soldiers killed or injured decreased ... The conclusion is that there was a relative compliance with the ceasefire," Colombian President Juan Manuel Santos said late on Sunday.

Santos said the FARC was involved in some violence during the ceasefire, but it was hard to tell whether the guerrillas were defending themselves or attacking.

Government forces have continued to attack and kill the rebels in their remote strongholds in the jungles and mountains of Colombia. Santos, who had rejected the ceasefire from the beginning, said the rebels may be planning a new offensive.

Marquez did not disclose their plans, but urged Santos to reconsider the government's decision not to lay down arms.

Colombian officials had called the ceasefire a sham to gain international favor and said the government would maintain the military pressure to keep FARC at the negotiating table.

Santos also said the government's armed forces had captured three members of the National Liberation Army, Colombia's second largest guerrilla movement, who were involved in the kidnapping on Friday of five mining company workers.

The group, including a Canadian, two Peruvians and two Colombians worked for the Canadian mining company Braeval at a gold mine project.

"We know the area in which they are, but we'll be careful to protect the lives of these people," Santos said.

LONG-RUNNING INSURGENCY

The two sides have been fighting since the formation of the FARC as a communist agrarian movement in 1964 in what is now Latin America's longest-running insurgency and a relic of the Cold War.

Tens of thousands of people have been killed and millions displaced in the conflict, which the FARC says is aimed at ending Colombia's long history of social inequality and the concentration of land and wealth in relatively few hands.

Officials say the FARC has been weakened by a U.S.-backed, 10-year-long government offensive.

But the group still has an estimated 9,000 fighters capable of continuing to inflict damage on Colombia's infrastructure and slow the government's plans to increase foreign investment in mining and oil operations.

The agenda for the talks calls for the two sides to address a number of difficult issues, starting with rural development.

In recent days, they have publicly disagreed about a sweeping land redistribution proposal by the FARC to hand over 25 million hectares (62 million acres), or more than 20 percent of the country's land, to the poor.

Government lead negotiator Humberto de la Calle this week called for a quicker pace to the talks, which Santos has said he wants ended by November.

Credit Agricole eyes up to 200 million euros in cuts: source

PARIS (Reuters) - Credit Agricole is working on a cost-cutting plan of 150 million to 200 million euros ($199 million to $266 million) through 2015 at its corporate and investment banking unit, a union source said.

The bank's management recently briefed unions on the planned expense reductions, reassuring them that there wouldn't be any new job cuts after the bank laid off 1,750 staffers last year, the source said.

"The management told us there wouldn't be any layoff plan," the source said, "but that there were expenses to be cut between 150 and 200 million euros, by 2015."

The plan is the latest sign that big European banks are having to resort to further cost cuts to try to boost profits as investment banking revenues remain erratic and retail and consumer lending are depressed by weak economic growth.

On Friday, a union source told Reuters that Credit Agricole's larger rival BNP Paribas planned to spend 1 billion euros over three years to pare down its business.

The Credit Agricole cost cuts would be found by not replacing departing employees, as well as unspecified cuts in the areas of real estate and information technology, the source said the unions were told.

A Credit Agricole spokeswoman declined to comment on the plan, which was first reported by newsletter Agefi.

Like other banks, Credit Agricole has been selling assets and streamlining its business to meet stricter regulations after the 2008 financial crisis. It was forced to take a 1.96 billion euro in writedowns on the sale of its Greek unit, Emporiki Bank, in November.

CARSON, Calif. (AP) ? When Notre Dame football star Manti Te'o ordered two dozen white roses delivered to 21503 Water Street, he says he thought they were headed to the home of his dead girlfriend, Lennay Kekua. In fact, the man implicated as the ringleader of a false-identity hoax and many of his relatives have lived in the single-story, stucco bungalow, according to publicly available records and interviews with neighbors.

Water Street, in a working-class community 13 miles south of downtown Los Angeles, adds another element to the Te'o-Lennay Kekua hoax: the house six doors down, at 21403 Water, belongs to a family named Kekua ? an uncommon Hawaiian name but the same one as the fictitious girlfriend at the center of the ruse.

Two members of the real Kekua family told The Associated Press they had never heard of a "Lennay Kekua."

The Kekua fabrication came to light Wednesday, when Deadspin.com revealed that the story of Te'o's girlfriend dying from leukemia last September was a fake ? because Lennay Kekua never existed.

Deadspin suggested Ronaiah Tuiasosopo was the person responsible for carrying out the hoax. Te'o said Friday he had been contacted by the 22-year-old Tuiasosopo, and that the man had admitted to masterminding the scam. Members of the Kekua family and others in the neighborhood told the AP on Saturday that Ronaiah Tuiasosopo had lived at 21503 Water St. and has visited it since moving out about a year ago.

The AP reviewed a compilation of documents about the property from a variety of sources, such as real estate and bankruptcy records.

In specifying where he had sent the roses, Te'o said Friday in an interview with ESPN that he still didn't know who lives at 21503 Water Street or of any possible connection between the address and the hoax.

But he did say he knew the residents had accepted delivery of the bouquet. "They sent me a picture of the roses, of them getting it," he said. And they also sent a photo of the flowers that Te'o's parents had delivered "as proof" that their tribute to the nonexistent girlfriend had been received.

Publicly available records indicate that Tuiasosopo used to live at 21503 Water Street. One neighbor said Saturday that Ronaiah had lived in the house for several years, until about a year ago. Another neighbor said that in her 27 years living on the block there had always been a Tuiasosopo living in 21503, including Ronaiah, his father and an uncle, Navy.

Multiple public records indicate that Navy, who played football for Utah State and the Los Angeles Rams, was a brother of former USC football player Titus Tuiasosopo, Ronaiah's father. A neighbor said Navy had lived at 21503 until his death in 2011.

A Cadillac still registered to Navy Tuiasosopo was parked in the driveway of Titus Tuiasosopo's home in Palmdale, about 90 miles north of Carson, on Saturday. Titus is the pastor of Oasis Christian Church of the Antelope Valley in Lancaster, Calif., and Ronaiah is active in the church band, and most recently has been living with his father.

In a joint interview Saturday, Barbara Kekua, 78, said she has lived at 21403 Water Street since it was built about 50 years ago. Her daughter, Kris Kekua, 45, grew up there, and moved back two years ago, across the street to 21406 Water, to be near her mother.

The two Kekua women said they do not know why their name was chosen for the scheme.

Kris recalled that when the story of Lennay Kekua's supposed death made national sports headlines last fall, friends asked if she was related. "I'm like, 'I don't know who that is,'" she said.

Kris said she had grown up with Titus and Navy on the block.

Some Signed Low-Rent Drilling Leases ? CBS Baltimore

OAKLAND, Md. (AP) ? The land men came one evening in 2006, offering property owners modest riches for a simple act: leasing their land rights to the natural gas industry?s middlemen.

Carl W. Lohr, a farmer in Friendsville, didn?t sign that night. But when the land men from the Lexington, Ky.-based Keeton Group LLC came knocking at his door weeks later, he leased his 156 acres to the company for five years, at $5 per acre, in return for allowing gas wells to be drilled using a controversial practice called hydraulic fracturing, or fracking.

At $5 an acre, Lohr is cut a check every year for less than $800. He?s happy with that amount, which he said is enough to cover real estate taxes in Garrett County. But other land owners, as close at hand as Pennsylvania, have signed leases for up to $6,000 per acre. And natural gas industry members and experts say it?s fairly common for some land men to sign property owners to a lowball lease and then resell the rights to energy companies for a big profit.

A commission formed by Gov. Martin O?Malley in 2011 to study fracking practices and safety agreed this week to recommend that legislation be introduced in the General Assembly to force land men to register with the state. This year?s session begins Wednesday.

The Pennsylvania experience

Jon Laughner, an extension educator with Pennsylvania State University?s College of Agricultural Sciences, said Maryland?s experience isn?t unique. He has tried to educate Pennsylvania residents about how some land men do business for years.

?Their goal is to accumulate a lot of land leases in an area and then flip them, sell them to the energy companies,? said Laughner, who has studied hundreds of leases in Pennsylvania, where there are far more natural gas deposits than in Maryland.

A man who answered the phone at The Keeton Group?s office declined to answer questions about the company?s leasing practices. Keeton persuaded hundreds of Garrett County residents to sign land leases starting in 2006, but the company is not alone in the complicated world of energy company land leases.

Land men ? sometimes brokers, sometimes contractors and sometimes direct employees of gas companies ? first descended in 2006 on Western Maryland, where the Marcellus Shale rock formation runs a mile below the surface. At that point, residents in Garrett and Allegany counties didn?t know what they had beneath them.

The Marcellus Shale formation is a rock-encased deposit of natural gas that can be extracted through a complicated process that involves drilling a mile deep and blasting a water and chemical mixture into the rock, fracturing it and releasing gas.

Companies that employ land men generally don?t have the wherewithal to actually extract the gas. They make their money by finalizing real estate deals, then selling groups of leases to natural gas exploration and production companies at a profit.

`Good and valuable consideration?

Laughner said energy companies and land men keep the details of their transactions secret, treating them as proprietary information. The sale of land leases can be tracked from company to company, but the purchase amount is usually described in court documents only as ?good and valuable consideration.?

Such is the case with Lohr?s lease, which from 2006 to 2010 changed hands from Keeton, to Unconventionals I LLC, to Chief Exploration & Development LLC and Radler 2000 Limited Partnership and finally to Chevron U.S.A. Inc., which bought the leasing rights to Lohr?s 156 acres and dozens of other lease agreements in July 2010.

Delmer R. Yoder, a 76-year-old farmer in Accident, said he didn?t sign with the land men when they came to Garrett County in 2006. Instead, he did some research.

What he found was that land owners in areas of the country that were already leasing property to gas companies were making far more money than the land men were offering Maryland residents. According to several people familiar with land leasing, the lease amount has been up to $6,000 per acre in Pennsylvania, West Virginia and elsewhere, with royalties on extracted natural gas reaching up to 18 percent.

?I started looking into this thing and calling different places around,? Yoder said. ?Come to find out that we could do better.?

Yoder started a group that quickly swelled to more than 200 county residents who wanted to lease their land. Yoder hired a consultant and negotiated a fee of $1,150 per acre.

Prices may vary

Lohr, who was among the first Western Marylanders to sign with the land men, said most of his neighbors followed suit. Some made out a little better than he did, garnering up to $15 an acre, but he said he was shocked to hear that the land he leased may be worth so much more.

At the price Yoder?s group had negotiated, Lohr?s payment of $780 per year would have swelled to $179,400.

?I had already signed up before he really created that group,? Lohr said.

But he was also grateful for the money he got. The recession and an executive order signed by O?Malley imposing a moratorium on fracking until 2014 have virtually halted all leasing activity, temporarily derailing the agreement reached by Yoder?s group.

The Daily Record reported in September that some gas companies were letting five-year leases expire having never drilled even a foot into the ground.

Lohr said he?s not upset with the land men who signed him up for $5 an acre. There was no arm twisting, he said, and he was happy for the extra money.

?It?s like a cattle sale,? Lohr said. ?Sometimes you?d get top dollar, and sometimes you didn?t. But I wish they would drill.?

Delvin E. Mast, a dairy farmer in Grantsville, was less forgiving. He said he signed with Samson Resources Co. for a relatively robust $25 an acre in 2007, but was disappointed when he learned the real value of his land. Mast said his lease has expired, which is fine by him ? he?s joining Yoder?s group, he said, and putting his 500 acres on the auction block.

?I?m not really disappointed that the lease is terminating,? Mast told The Daily Record in September. ?But I do wish Maryland would get their act together.?

Laughner, who said early leases signed in Western Pennsylvania in 2005 and 2006 were usually for $5 to $10 an acre, said the college?s extension office was trying to make sure land owners didn?t make up their minds without knowing what was involved.

?When somebody showed up in 2005 or 2006 and said, `We?d like to lease the land for $5 an acre,? it didn?t seem unusual. People have been doing it for decades,? Laughner said. ?They (thought they) knew there wasn?t any gas there, so take the $5 an acre and run.

?I suspect there was a little bit of knowledge (on the industry?s side) that there was a potential for these leases to be a lot more valuable than $5 an acre. But it was not apparent to the general public.?

`Nice pocketful of change?

That?s what Yoder said drove hundreds of land owners to sign for far less money than they should have.

?I?m sure they made a nice pocketful of change,? Yoder said of the land men who brokered many of the early deals. ?But I?m not blaming the people that signed in for $5 an acre. They didn?t know no better.?

Once people did know better, elected officials in Western Maryland started to search for ways to protect land owners.

It was Sen. George C. Edwards and Del. Wendell R. Beitzel, Republicans who exclusively represent the portion of the state that includes Marcellus Shale deposits, who introduced legislation last year that would have forced land men to pay a $100 fee and register with the state Department of Labor, Licensing and Regulation.

The bill would have provided a modicum of accountability, Edwards said ? an argument that has belatedly been recognized by the Marcellus Shale Safe Drilling Initiative Advisory Commission.

The Senate version of the 2012 bill, heard in the Education, Health and Environmental Affairs Committee on March 6, was relegated to a drawer by Sen. Joan Carter Conway, a Baltimore Democrat who chairs the committee and has not had her panel vote on several fracking-related bills in the last two legislative sessions.

Beitzel?s version of the bill was bounced from the House of Delegates? Environmental Matters Committee into the Economic Matters Committee, where it ultimately received an unfavorable report in late March, preventing it from being considered by the full chamber.

Making it legit

Edwards, who wants fracking to happen in Western Maryland ? he sees economic benefits to it ? said the land men ought to be held accountable.

?We want to make sure they?re legitimate ? legitimate with the state, so people dealing with them know that,? Edwards said in a recent interview.

He noted there is a national group, the American Association of Professional Landmen, but pointed out that isn?t a regulatory body, just an organization whose members are held to a code of ethics. Section 1 of that code says land men should strive to treat land owners fairly. A call to the association was not returned.

Edwards said legislation also should consider including lease requirements, to ensure land owners are getting appropriate payments for allowing companies to drill. The commission has thus far balked at making such a recommendation.

?Should there be a minimum royalty and maybe the per-acre lease (should have a minimum)?? Edwards said, ticking off various lease components that ought to be discussed. ?Should there be other certain things in the lease??

Yoder said his group just wanted a fair deal. He?s frustrated that the state?s regulatory framework for fracking hasn?t been determined and that O?Malley?s moratorium has delayed his group?s ability to sign with a natural gas company.

?Right now, we?re just waiting to see what?s going to happen,? Yoder said. ?Right now, we can?t do anything. Once the gas companies can get leases and start drilling, I think I think we can probably regroup and go from there.?

But only if gas companies and their land men offer fair value for what lies beneath the surface of Western Maryland.

?It?s got to be a two-way street,? Yoder said. ?We got to make money, and so do the gas companies.?

Many in the blogosphere believed her saying ?I beat Meryl!? during her Golden Globes speech Sunday was a dig at?Meryl Streep,?an?interpretation Lawrence denied. But she had no qualms about bashing her Oscar competition, using her opening?monologue?to say something nasty about each of her rivals.

Likewise, the episode?s final sketch sees Lawrence play a Civil War-era woman pining for her soldier suitor. While she writes him flowery dispatches, he composes letters using modern slang.

Marines studying mindfulness-based training

CAMP PENDLETON, Calif. (AP) ? The U.S. Marine Corps, known for turning out some of the military's toughest warriors, is studying how to make its troops even tougher through meditative practices, yoga-type stretching and exercises based on mindfulness.

Marine Corps officials say they will build a curriculum that would integrate mindfulness-based techniques into their training if they see positive results from a pilot project. Mindfulness is a Buddhist-inspired concept that emphasizes active attention on the moment to keep the mind in the present.

Facing a record suicide rate and thousands of veterans seeking treatment for post-traumatic stress, the military has been searching for ways to reduce strains on service members burdened with more than a decade of fighting in Iraq and Afghanistan.

Marine Corps officials are testing a series of brain calming exercises called "Mindfulness-Based Mind Fitness Training" that they believe could enhance the performance of troops, who are under mounting pressures from long deployments and looming budget cuts expected to slim down forces.

"Some people might say these are Eastern-based religious practices but this goes way beyond that," said Jeffery Bearor, the executive deputy of the Marine Corps training and education command at its headquarters in Quantico, Va.. "This is not tied to any religious practice. This is about mental preparation to better handle stress."

The School Infantry-West at Camp Pendleton will offer the eight-week course starting Tuesday to about 80 Marines.

The experiment builds on a 2011 study involving 160 Marines who were taught to focus their attention by concentrating on their body's sensations, including breathing, in a period of silence. The Marines practiced the calming methods after being immersed in a mock Afghan village with screaming actors and controlled blasts to expose them to combat stress. Naval Health Research Center scientist Douglas C. Johnson, who is leading the research, monitored their reactions by looking at blood and saliva samples, images of their brains and problem-solving tests they took.

Another 160 other Marines went through the mock village with no mindfulness-based training, acting as the control group. Results from the 2011 study are expected to be published this spring.

The latest study by Johnson will compare three groups of Marines, whose biological reactions will be also monitored. One group of about 80 will receive mindfulness-based training. Another of equal size will be given mental resilience training based on sports psychology techniques. The third one will act as a control group.

Results from that study are expected in the fall, Marine Corps officials said.

Marine Corps officials decided to extend the experiment to shore up evidence that the exercises help the brain better react to high-stress situations and recover more quickly from those episodes.

"If indeed that proves to be the case, then it's our intention to turn this into a training program where Marines train Marines in these techniques," Bearor said. "We would interject this into the entry level training pipeline ? we don't know where yet ? so every Marine would be trained in these techniques."

The idea is to give Marines a tool so they can regulate their own stress levels before they lead to problem behavior: "We have doctors, counselors, behavioral health scientists, all sorts of people to get help for Marines who have exhibited stress type symptoms but what can we do before that happens? How do we armor Marines up so they are capable of handling stress?" Bearor said.

Lance Cpl. Carlos Lozano participated in the 2011 study, taking the course during his pre-deployment training that also included catapulting from a helicopter in a simulated raid and enduring booming explosions in a mock Afghan village.

Lozano said he and fellow Marines were skeptical at first. Some wondered why their rigorous combat training was being interrupted by a class asking the warfighters to sit in silence and stare at their combat boots, becoming aware of how their feet touched the classroom floor.

"I didn't want to do it," the 21-year-old from Denver said.

But the exercises ? also done while standing, stretching and lying down ? had an effect, he said. He felt more relaxed and upbeat.

"Mindfulness-based Mind Fitness Training" or "M-Fit" was designed by former U.S. Army Capt. Elizabeth Stanley, a professor at Georgetown University who found relief doing yoga and meditation for her PTSD.

Stanley, who is also involved in studies for the Army, said the techniques can help warfighters think more clearly under fire when they are often forced to make quick decisions that could mean life or death, and help them reset their nervous systems after being in combat.

Maj. Gen. Melvin Spiese said he was convinced after looking at the scientific research and then taking the course.

While teaching troops to shoot makes them a better warfighter, teaching mindfulness makes them a better person by helping them to decompress, which could have lasting effects, he said.

"As we see the data supports it, it makes perfect sense that this is what we should be doing," said the 58-year-old outgoing general, sitting in his office adorned with pictures of war and a 1903 rifle. "It's like doing pushups for the brain."
